Description
1 Michael Chesir appeals from a circuit court order denying his WIS. STAT.§ 974.06 (2005-06)post-conviction motion by which he sought a new trial on the basis of newly-discovered evidence and on the basis of ineffective assistance by trial and appellate counsel. We conclude that Chesirs motion was procedurally barred because he twice previously sought post-conviction and appellate relief and did not articulate an adequate reason for failing to raise these issues in those previous post-conviction proceedings. See State v. Escalona-Naranjo, 185 Wis. 2d 168, 181-82, 517 N.W.2d 157 (1994) (post-conviction claims that could have been raised in prior post-conviction or appellate proceedings are barred absent a sufficient reason for failing to raise the claims in the earlier proceeding). We therefore affirm the circuit courts order.
